Terms of Service

These terms govern your use of xfg-market.com and any order you place with Fittedd, Dr Schaepmanstraat 13, 3314 RH Dordrecht, Netherlands, registered in the Netherlands under company number 83969969. By placing an order you accept these terms.

1. Definitions

  • “We”, “us”, “our” means Fittedd.
  • “You” means the person or company placing an order.
  • “Goods” means the electrical equipment and accessories we supply.
  • “Consumer” means a natural person acting outside their trade or profession, as defined in Dutch and EU consumer law.

2. Orders and acceptance

  • Product listings and price ranges on the Site are an invitation to request a quotation, not a binding offer.
  • A contract is formed when we send you an order confirmation or a signed quotation.
  • We may refuse or cancel an order where goods are unavailable, a pricing or specification error is discovered, or where fraud is suspected. Any payment already made is refunded in full.
  • Quotations are valid for 14 days unless stated otherwise.

3. Prices, VAT and payment

  • Catalogue prices are indicative EUR ranges excluding VAT. The binding price is the one on your quotation or order confirmation.
  • Dutch VAT at the prevailing rate is added where applicable. Intra-community supplies to a valid EU VAT number can be invoiced under the reverse charge.
  • Accepted payment methods are set out on our Payment Options page. Goods remain our property until paid for in full (retention of title).
  • Late payment on invoiced accounts attracts statutory commercial interest and reasonable collection costs under Dutch law.

4. Delivery

  • All orders are shipped with DHL, tracked and insured, from our warehouse in Dordrecht.
  • Delivery times quoted are estimates and are not of the essence unless expressly agreed in writing.
  • Risk in the goods passes to you on delivery; for consumers, risk passes when you or a person you nominate takes physical possession.
  • Please inspect shipments on arrival and report visible transit damage within 48 hours.

5. Product information and suitability

  • Technical data, images and dimensions are supplied by the manufacturer and are indicative; always check the current datasheet before installation.
  • You are responsible for confirming that an article is suitable for your installation, load and environment, and for compliance with NEN 1010 and other applicable installation standards.
  • Electrical equipment must be installed by a competent person in accordance with the manufacturer's instructions and local regulations.
  • We may supply an equivalent article of equal or better specification where the exact reference is unavailable, with your agreement.

6. Warranty and conformity

Goods carry the manufacturer's warranty, in most cases 24 months, alongside your statutory conformity rights. Warranty claims are handled as described in our Return and Refund Policy. The warranty excludes damage from incorrect installation, overvoltage, overload, water ingress beyond the stated IP rating, unauthorised modification and normal wear.

7. Returns and cancellation

Consumers have a 14-day right of withdrawal for distance purchases. Full details, exclusions (including cut cable and special-order articles) and the return procedure are in our Return and Refund Policy.

8. Liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be limited — including a consumer's statutory rights.
  • For business customers, our total liability for any order is limited to the invoice value of that order.
  • We are not liable to business customers for indirect or consequential loss, including loss of profit, production downtime or contract penalties.
  • We are not liable for delays caused by events outside our reasonable control, including carrier disruption and manufacturer shortages.

9. Use of the Site

  • You may not use the Site unlawfully, attempt to gain unauthorised access, scrape it at scale, or interfere with its operation.
  • All content, branding and imagery on the Site is owned by us or our licensors and may not be reproduced without permission.
  • We may update, suspend or withdraw parts of the Site without notice.

10. Privacy

Personal data is handled as described in our Privacy Policy and our Cookie Policy, in accordance with the GDPR.

11. Governing law and disputes

These terms are governed by Dutch law. Disputes are submitted to the competent court in Rotterdam, the Netherlands, without prejudice to any mandatory rights a consumer has to bring proceedings in their country of residence. Consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. The Vienna Sales Convention (CISG) does not apply.
